A courier was making a delivery of heavy rolls of aluminum. At his destination, an employee of the receiving company tried to unload the shipment with a pallet jack. The employee lost control of the pallet jack and jumped off of the truck. The pallet of rolls of aluminum got loose and landed on our client’s leg.

As a result of the accident, our client suffered a fracture of his right tibia and fibula. He underwent a surgery called an open reduction internal fixation of his leg. And, he had a subsequent surgery to remove the hardware later on.

We sued the company that originally loaded the shipment in such a way that a forklift could not be used to unload it. We filed suit against the company that unloaded the shipment in a dangerous manner. After numerous depositions of witnesses and experts, the case settled a few days before trial for $700,000.
